1.Scope and effect
This Acceptable Use Policy (the Policy) governs all use of the Wavn service and forms part of the Terms of Service. Capitalised terms not defined here have the meanings given in the Terms.
This Policy applies to you, to every Authorised User under your Account, and to any person you permit to access the Service through you. You are responsible for their compliance.
Breach of this Policy is a material breach of the Terms and may result in the measures set out in section 8.
This Policy applies to Input you submit, to Output you generate, retain, publish or distribute, and to any application or material you deploy through the Service.
2.Unlawful and harmful activity
You must not use the Service to engage in, facilitate, promote or conceal any of the following.
Activity that violates Applicable Law, including:
- fraud, deception, phishing, pretexting, or any scheme to obtain money, credentials or data by misrepresentation;
- money laundering, terrorist financing, sanctions evasion, or dealings with sanctioned persons or territories;
- unlawful gambling, unlicensed financial services, or the unlicensed practice of a regulated profession;
- trafficking in persons, controlled substances, weapons, stolen goods, or protected wildlife;
- infringement or misappropriation of any patent, copyright, trademark, trade secret, database right, moral right, right of publicity or other proprietary right; or
- breach of any duty of confidence, contract or court order.
Activity directed at people, including harassment, stalking, bullying, threats of violence, incitement to violence or self-harm, doxxing, or the targeted degradation of any person or group on the basis of a protected characteristic.
Sexual content involving minors in any form, whether real, drawn, described or synthetic. Wavn reports apparent child sexual abuse material to the National Center for Missing & Exploited Children and to competent authorities, preserves the associated records, and terminates the Account without notice or appeal.
Non-consensual intimate imagery, sexualised depictions of identifiable people created without their consent, and material produced to sexually exploit or extort any person.
3.Deception, impersonation and synthetic media
You must not use the Service to impersonate any person or organisation, or to misrepresent your identity, affiliation, qualifications or authority.
You must not use the Service to generate or distribute synthetic depictions of a real, identifiable person’s likeness or voice in a manner intended or likely to deceive, without that person’s consent.
You must not present Output as human-authored where Applicable Law requires disclosure that it is AI-generated, nor remove, alter or obscure provenance metadata the Service embeds in generated images or clips.
You must not use the Service to generate or distribute material designed to interfere with an election, a referendum, a census or a judicial or regulatory proceeding, including fabricated statements attributed to candidates, officials or institutions.
You must not use the Service to fabricate evidence, forge a document, or create a record purporting to be an authentic business, financial, governmental, medical or academic record.
You must not represent that Wavn has verified, endorsed, certified or approved any Output, any decision, or any material you produce.
4.High-risk and regulated uses
The Service is a decision-support and productivity tool. It is not certified, validated or fit for use as a component of a system where failure could cause death, injury, or severe legal or financial harm.
You must not use the Service, or any Output, as the sole or determinative basis for a decision in any of the following, nor deploy it in a manner that produces such a decision without qualified human review:
- medical diagnosis, treatment, triage, dosing, or any clinical decision affecting a patient;
- the operation, navigation or safety control of vehicles, aircraft, vessels, industrial plant, weapons, or critical infrastructure;
- eligibility for employment, credit, insurance, housing, education or public benefits, or the setting of their terms;
- law enforcement, immigration, border control, criminal risk assessment, sentencing, parole, or the exercise of any coercive state power;
- biometric identification or categorisation of individuals, or emotion inference in workplace or education settings;
- structural, civil, electrical or safety engineering determinations relied on for construction or certification; or
- legal advice, filings or representations tendered to a court, tribunal or regulator without review by a qualified licensed practitioner.
You must not use the Service in a manner that would render Wavn a provider or deployer of a prohibited practice or a high-risk AI system under Regulation (EU) 2024/1689, or subject Wavn to obligations under sector-specific regulation to which it is not a party.
Where you use the Service in a regulated field, you remain solely responsible for compliance with the professional, licensing, supervisory and record-keeping duties of that field.
5.Data you must not submit
You must not submit personal data you have no lawful basis to process, or that you obtained in breach of a duty owed to the individual concerned.
You must not submit special categories of personal data under Article 9 of Regulation (EU) 2016/679, protected health information subject to the Health Insurance Portability and Accountability Act, payment card data subject to PCI DSS, biometric identifiers, precise geolocation of identifiable individuals, or the personal data of children, unless Wavn has agreed in writing in advance to receive it. The Service is not configured to receive such data.
You must not submit classified information, export-controlled technical data, or material whose disclosure to a sub-processor identified on the Sub-processor List would breach a duty you owe to a third party.
You must not submit material containing malware, or content engineered to cause the Service to behave unsafely, including prompts designed to override system instructions or to extract another user’s data.
6.Integrity of the Service
You must not attempt to circumvent any usage limit, rate limit, allowance, paywall, access control, authentication mechanism or technical protection measure, nor create multiple Accounts to do so.
You must not access the Service by automated means, scrape it, or resell, sublicense or provide it to a third party, except as expressly permitted by the Terms.
You must not use the Service or Output to develop, train, fine-tune, benchmark for publication, evaluate or improve any machine learning model, foundation model or service competitive with Wavn.
You must not probe, scan or test the vulnerability of any Wavn system, or attempt to gain unauthorised access to any account, system or data, except under a written authorisation from Wavn. Good-faith security research conducted under section 7 is not a breach of this clause.
You must not impose a disproportionate load on Wavn infrastructure, or use the Service in a way that degrades it for others.
You must not use the Service to send unsolicited bulk communications, or to build, verify or enrich a mailing list you lack consent to contact.
7.Reporting a breach, and security research
Abuse reports. Report suspected breaches of this Policy to abuse@wavn.ai. Include the material or address concerned, the conduct you observed, and how you can be contacted. Reports may be made anonymously, though this may limit the investigation.
Intellectual property complaints. Claims of copyright or trademark infringement should be sent to legal@wavn.ai with: identification of the protected work and of the material claimed to infringe it, sufficient to locate both; your contact details; a statement that you have a good-faith belief the use is not authorised; a statement, made under penalty of perjury, that the information is accurate and that you are the rights holder or authorised to act for them; and your signature. Wavn responds to valid notices and will terminate the accounts of repeat infringers.
Security research. Report vulnerabilities to security@wavn.ai. Wavn will not pursue legal action against a researcher who acts in good faith, tests only against accounts they control, does not access, modify, exfiltrate or destroy another party’s data, does not degrade the Service, and gives Wavn a reasonable opportunity to remediate before disclosure.
8.Enforcement, notice and appeal
Measures available. Where Wavn reasonably determines that this Policy has been breached, it may, proportionately to the breach: issue a warning; remove or restrict access to specific material; restrict a feature; suspend the Account in whole or in part; terminate the Account; and, where required or permitted by Applicable Law, report the matter to a competent authority.
Notice and reasons. Except where immediate action is necessary to prevent imminent harm, to comply with Applicable Law, or where notice would prejudice an investigation or a legal process, Wavn will notify you of any measure taken, identify the provision of this Policy relied upon, and describe the material or conduct concerned.
Opportunity to remedy. Where a breach is capable of remedy and does not involve conduct under clauses 2.3, 2.4 or 3.5, Wavn will ordinarily allow a reasonable opportunity to remedy it before suspending or terminating an Account.
Appeal. You may contest a measure by writing to appeals@wavn.ai within thirty (30) days, stating the grounds and any facts you say were misunderstood. Wavn will review the decision, and the review will not be conducted solely by the automated process that produced the original measure. Wavn will notify you of the outcome and its reasons.
Effect on data. Termination for breach does not extinguish your rights in respect of your personal data under the Privacy Notice. Wavn may retain material necessary to establish, exercise or defend a legal claim, or to comply with a legal obligation, for as long as that purpose subsists.
Judgment. Wavn applies this Policy in good faith and proportionately. Conduct not specifically enumerated here breaches this Policy where a reasonable operator would regard it as materially equivalent to conduct that is enumerated; this clause is a standard of interpretation and does not create an open-ended discretion.
9.Changes to this Policy
Wavn may amend this Policy. The amended Policy will be posted on this page with a new version number and effective date in the masthead, and recorded on the changelog.
Where an amendment materially expands what is prohibited, Wavn will give at least thirty (30) days’ notice before it takes effect, except where a shorter period is required to address an unlawful or harmful use or to comply with Applicable Law.
